Privacy Statement

Bennet & Boss aims to live up to the belief and expectations of our candidates and clients that we handle personal data with utmost care and discretion. We work with well-protected information systems and clear privacy statements. If deemed necessary, we adjust these means. With the introduction of the General Data Processing Regulation (AVG) and in preparation and anticipation of the ePrivacy Regulation, we hereby present our updated Privacy Statement in which we outline how we handle your personal data.

We are Bennet & Boss. Bennet & Boss is established and located in The Hague, on the Laan van Nieuw Oost-Indië 131H, 2593 BM and is responsible for processing your personal data.

Of whom does Bennet & Boss collect personal data

We collect personal data from:

  1. Visitors and/or users of the Bennet & Boss website and corporate LinkedIn profile:
    • We collect data and information regarding the usage of the website and corporate LinkedIn profile, which we apply in order to optimize and improve our website and corporate LinkedIn profile to the liking and usability of the visitors and/or users;
    • The collected data and information we process with your consent;
    • The collected data and information we process to properly execute the agreement and/or user conditions;
    • The collected data and information we process, comprises of data and information regarding applicants, (potential) candidates, zzp-ers (self-employed entrepreneurs), supplier employees and/or others.
  2. We collect and process data in order to execute our project services, including intermediary, secondment, payroll, recruitment & selection, hiring and rehiring, personal development, employability and advice.
    • The collected data and information we process to properly execute the agreement and/or user conditions;
    • The collected data and information we process to comply with a legal obligation;
    • The collected data and information we process based on a legitimate interest that is in accordance with and/or arises from the earlier stated purposes (why we process personal data) and after careful assessment, deliberation and weighing up interests.

Which personal data we process, why, to whom we provide information and how long we keep your information

Business Relations

We process personal data of employees working for companies which we do business with, in order to (1) make offers and/or provide information regarding our services and other activities, (2) maintain a professional business relationship and (3) make and maintain an assignment agreement;

  • The collected data and information we process to properly execute the agreement and/or user conditions;
  • The collected data and information we process to comply with a legal obligation;
  • The collected data and information we process based on a legitimate interest that is in accordance with and/or arises from the earlier stated purposes (why we process personal data) and after careful assessment, deliberation and weighing up interests;
  • The collected data and information we process with your consent.

Personal Relations

We collect your personal data when you;

  • Visit or use the Bennet & Boss website and/or corporate LinkedIn profile;
  • Enter or leave an inquiry or your details on our website;
  • Apply through LinkedIn of by creating an account on the website;
  • Register at Bennet & Boss in any other way to either use our services or for us to provide a service to you;
  • Are assumed interesting for an assignment by Bennet & Boss from our online channels or when we have a legitimate reason to assume that you would be interested. In both cases, we will contact you to perhaps register with us or to see how we can be of service to you. In case you are not interested, we will process relevant data to take into account your wish not to be approached by us.
  • Have given us referent details from whom we receive personal information;
  • Are signed up at Bennet & Boss by clients you have approached or worked for previously or the clients share personal information with us, if this is ensues from our agreement;
  • Are referred to by suppliers in the context of hiring and rehiring, in which case the supplier will inform you and refer to our privacy statement.

With whom can we share your personal information with

Bennet & Boss can pass on your personal data to the following (categories of) recipients;

  • Subcontractors and suppliers (such as data processors), who provide services or carry out assignments on behalf of Bennet & Boss. These recipients only have access to the data they need to perform their duties and are bound by contractual obligations;
  • Third parties such as service providers, who perform duties on behalf of Bennet & Boss (including testing, training, and/or examination institutes, parties that perform customer satisfaction measurements to attain certification, external consultants, business partners and professional advisors, such as lawyers, auditors, technical support and IT consultants who develop and test our systems);
  • Clients whom we can introduce you to, where you are currently working or have previously worked via Bennet & Boss, or who have requested our intermediary services for you to start working there.
  • Individuals and organizations that have information regarding your reference or suitability, such as diplomas or potential employers, educational and examination institutes who have requested your and/or our information;
  • Third parties to whom we provide data, with your explicit consent, or share data with at your request in connection with data portability;
  • Pension fund, if applicable;
  • Governmental agencies and others, such as grant applicants, in case we believe that we are required or entitled to do so. And in all other cases in which we have the obligation to do so, for example through a court order or a court judgment.

The sharing of personal data takes place on the basis of a legitimate interest, consent, legal obligation and/or for the implementation of the agreement in accordance with the purposes as stated under "Why do we collect your personal data?" mentioned above.

Your personal data can be transferred or stored outside the Netherlands. Bennet & Boss has taken the necessary measures to ensure that the transferred personal data are adequately protected. Your personal data can be sent to one or more countries within or outside the European Union and processed there. We will only transfer your personal data to countries outside the EU, when that location is believed to have adequate data protection laws and regulations by the European Commission or where Bennet and Boss has taken appropriate security measures to ensure the privacy of your data. Your rights

The following rights apply in the context of Privacy and data protection;

  • You have the right to submit a request for access to personal data which we process or have processed about you;
  • You have the right to submit a request for the rectification of your personal data;
  • You have the right to submit a request to delete your personal data or limit the processing of your personal data, which Bennet & Boss can deny in case there is a legal obligation, to fully process the personal data or not to delete;
  • You have the right to object to the processing of personal data;
  • You have the right to submit a request for the transfer of your data.

For personal data protection purposes, we must be able to establish your identity, in case you submit a request. We do not use automated decision making, which is based solely on automated processing including profiling.

For candidates, seconded and/or self-employed personnel and clients with an account on our website;

  • As the processing of your personal data is based on your consent, you also hold the right to withdraw your consent at any given time. However, the withdrawal of your consent does not affect the legality of any data processing based on your prior consent or in the event that further processing of the same data is continued on a different basis, such as an agreement or legal obligation of Bennet & Boss.

How can you withdraw permission;

  • In case you have registered to receive information for news items, events, alerts or other messages, you can unsubscribe via the unsubscribe option in the mail you receive;
  • Prevent cookies from being placed via your browser settings and/or change or remove your cookie settings from your device at any time via the browser settings;
  • In case you want to change or delete data, but are not able to do so yourself, contact your contact person and/or our office staff process the changes.

Questions, comments, complaints or (suspected) data breach

Security

Bennet & Boss aims to optimally protect your personal data. We do that based on our information security policy. In order to execute this, we have taken physical, administrative and organizational measures to prevent unauthorized use, taking into account the latest technology. These measures are regularly evaluated and, if deemed necessary, updated.

In order to guarantee the same level of protection, Bennet & Boss has agreed with data processors to incorporate the same measures in case data is processes to provide services or carry out assignments. Be aware that you are responsible for the security of your computer equipment and/or telephone and your own internet connection, and beware that it is never 100% secure. Sending personal data via the internet is therefore at your own risk.

Amendments

Bennet & Boss may make changes, additions or amendments to its Privacy Statement for a variety of reasons. The most current Privacy Statement can be viewed at all times on the website. We recommend that you regularly read in the Privacy Statement. This version was drawn up in May 2018.

We collect and process your data in order to execute our project services, including, intermediary services, project secondment, payroll, recruitment & selection, hiring and rehiring, employability and advice. Which personal data do we collect from you

We process the personal data that are necessary for our services; part of this data is mandatory to be able to use our services as we cannot provide our services without this data. Additional data may be desirable to obtain a better match between our services and your wishes, qualities and/or availability. Additional data can also be used to meet more specific questions or obligations with regard to the position and/or from clients. We ask that you only provide us with information that is accurate and relevant.

We may also collect (contact)details from you, in case you have publicly released this information, but only if we have a legitimate reason to assume that you would be interested in work or our services. In that case we will contact you to discuss the possibility of you registering with us, in accordance with our terms and conditions and in adherence to this Privacy Statement. You are yourself responsible for personal data you have yourself publicly released via or on the internet. Tip: check regularly online to see if there is no information circulated without your knowledge and/or consent.

More specifically, it concerns the following (documents with) personal data.

Upon registration

  • Name, address, residence details, e-mail address and other contact details;
  • Date of birth, age, gender;
  • Curriculum Vitae (CV), information regarding education, internships and work experience;
  • Data regarding training and education and/or testing, that you have followed or have done yourself or via us;
  • Data in regard to availability and leave;
  • Data that may be important in the context of the assessment of your suitability as a candidate, for example references and certificates;
  • Passport sized photo and video (introduction) - on a voluntary basis;

The identification may be stored and checked during the recruitment and selection process in order to determine whether you are eligible to work in the Netherlands. In case you do not start working via Bennet & Boss within 12 weeks or more, the initially stored identification will be removed and deleted.

We are committed to an inclusive work field that includes everyone who is willing to work. We request data regarding gender to be able to effectively communicate with you, regarding your age to be able to identify you in our database and to determine whether we have certain obligations, with regard to salary and whether we are entitled to forms of subsidy.

When you are able to start working for Bennet & Boss

  • Nationality, social security number, identification, work permit;
  • Other data related to personnel, salary and absence registration;

In case you are hired and rehired via Bennet & Boss;

  • Data necessary in the context of limiting the hirers liability, such as name and address, residence, date of birth, social security number, type of identification, identification number and period of validity and if at hand: residence permit, 30% declaration, work permit;

Bennet & Boss only records special personal data if it is necessary to meet its legal obligations, or if otherwise permitted by or pursuant to the law. By "special personal data" we mean; details in regard to race or ethnic origin, political views, religion or philosophical belief, genetic and biometric data, health, sexual life, trade union membership, criminal personal data and/or personal data regarding unlawful or disturbing behaviour.

Why do we collect your personal data

  • improve our services; for example, if we record conversations for training purposes, we will inform you in advance;
  • be able to assess your suitability and availability in regard to our intermediary services for a permanent position or an assignment. There can be made use of test results, reference checks and social media (only if this is relevant for the position and in indicated in the vacancy text);
  • gain insight into potential companies for work and how we can support or advise in the job search;
  • introduce you to our clients, which can be done by means of sound and/or visual material, such as videos or photos, only if you have provided these to us on a voluntary basis or have had them provided to you;
  • plan you as best as possible according to your wishes and availability and the possibilities with our client;
  • maintain a professional relationship and record this in an administration;
  • record an assignment in an agreement with the client and to maintain and fulfil this agreement;
  • promote your personal development and employability, through training, education and testing;
  • manage information, taking care of internal audits and operational safety and conducting audits and auditing for management purposes;
  • meet quality objectives such as certification;
  • be able to claim subsidies, premium discount and/or wage cost benefits;
  • be and maintain compliant to laws and regulations, including but not limited to identification, labour legislation, tax and social security legislation, retirement, fraud prevention and national and international sanctions legislation.

How long do we save your personal data in our administration and database

We determine the required retention period on the basis of legislation, regulations and possible claim risks, whereby our objective is that we do not save the data longer than necessary.

Details, such as CV, work experience, training, test results are available up to two years after the last contact, if you have since then not worked for Bennet & Boss. You will receive a message from us one year after the last contact moment as well as after two years after the last time you were registered with us.

If you no longer want to be mediated, you can indicate this at our office at Bennet & Boss or at your contact person. You will no longer be approached and/or mediated by Bennet & Boss. Your personal data is still available for three calendar months in a protected environment (with Recruitment & Selection this period is 24 months) in connection with claim risks. In this protected environment, your data is only available to Bennet & Boss under strict conditions in accordance with the objectives and deadlines set for that purpose. Your data will be permanently deleted after the aforementioned periods.

When you are working or have worked for Bennet & Boss

Your personal data is available up to two years after the end of your employment period. Certain personal data are available to Bennet & Boss for a longer period of time for purposes such as claims, audits and tax obligations. You can find more information about this in the GB project agreement.

If you no longer want to be mediated, you can indicate this at our office at Bennet & Boss or at your contact person. You will no longer be approached and mediated by Bennet & Boss. In that case, your personal data will be archived after two years in a protected environment. Your personal data will then only be available to Bennet & Boss under strict conditions in accordance with the applicable goals and deadlines.
